Michael Jordan Testifies He Felt No Fear of Nascar in Legal Battle

Michael Jeffrey Jordan, as he cordially introduced himself in a federal courtroom on Friday, stated that his competitive side and status as a newcomer motivated his effort with 23XI Racing to “challenge” Nascar over perceived violations of competition laws.

Financial Stakes and a Competitive Drive

Jordan shared financial and corporate details of his 23XI team, revealing he put in $40m of his own funds into the Nascar Cup series team launched with partner Polk and longtime driver Denny Hamlin.

“Someone had to step forward,” Jordan stated in the Charlotte courtroom. “As a newcomer, I had no fear. I believed I could take on Nascar in its entirety. From my perspective, the sport required examination through a new lens.”

Central Issue: Charter Agreements and Contract Pressure

The heart of the case involves the end of a 2016 agreement where Nascar provided each team a “charter”. This system mirrors other professional sports with separately owned franchises, such as the Charlotte Hornets or the Carolina Panthers. The agreement was set to expire in 2024 when Nascar insisted on charter membership renewals.

Jordan testified for an hour and exited the courthouse to a media frenzy, with fans and media vying for a view or a photo of the sports legend.

Spearheading the Fight

But in the end, the pushback against what he saw as a unsustainable system was mostly about the usual bottom line for Jordan: Winning.

“Hamlin persuaded me adding a third car boosted our odds of winning,” he said, noting that he bought a third charter last year for $28 million amid the legal dispute. “So I dove in.”

Heather Gibbs detailed her request for permanent charters, which she said a written letter to Nascar. She testified the pressure of the signature deadline didn’t sit well.

She said, Joe Gibbs first tried to call and talk Nascar out of demanding signatures, but Nascar’s leader declined the request.

“Please don’t force this on us,” Heather Gibbs said was the message to Nascar’s leadership. The response was, “If I wake up and I have 20 charters, that’s what I have. If I have 30, that’s the number.”
